Commercial company ordered to pay lawyer BD600 for unpaid fees

The High Civil Court has ordered a commercial company to pay BD600 to a lawyer for unpaid fees for the final month of his contract. The court, however, refused to hold the company’s partners liable for the payment, affirming that the company has an independent legal personality separate from its members.

The court also declined to impose interest on the amount as legal fees are considered a civil debt. The lawyer had filed a lawsuit seeking BD2,400 from the company and its partners, jointly and severally.

He argued that he had entered into a legal services agreement with the company to represent it in court and handle all legal matters.

He claimed that the agreement was terminated without the payment of his final month’s fees, amounting to BD600, and that the company had failed to adhere to the three-month notice period stipulated in the agreement for termination.

Compensation He also requested compensation for the notice period, amounting to BD1,800.

The court found that the company had indeed notified the lawyer of the termination after the due date for the monthly fees, making the lawyer’s claim valid. As the company had not provided evidence of payment, the court ordered the company to pay the lawyer BD600 for the outstanding fees.

Contractual right Regarding the claim for BD1,800 for the notice period, the court found that the company had exercised its contractual right to terminate the agreement.

The court ruled that the lawyer had not provided evidence of damages incurred due to the lack of notice, and therefore dismissed the claim.

The court ultimately dismissed the lawsuit against the company’s partners, finding them not liable for the payment as the company itself was responsible for its contractual obligations.
