Ruling overturned, husband wins appeal against spousal support

The High Appeals Court has overturned a ruling that obligated a Bahraini man to pay over BD15,000 in spousal support spanning 10 years. This decision marks a significant victory for the man, who argued that he had consistently fulfilled his financial obligations towards his estranged wife.

According to the man’s lawyer, the case began in 2011 when the couple married. They had a son and a daughter together. I

n April 2014, the wife filed an urgent lawsuit seeking spousal support, resulting in a court order requiring the husband to pay 50 dinars monthly for his wife and BD100 monthly for their children, effective from the date of the ruling.

In response, the husband filed a lawsuit against his wife, leading to a court order compelling her to return to the marital home on February 15, 2015.

Despite the initial support order, the husband maintained that he had consistently fulfilled his financial obligations towards his wife and children from the September 17, 2014, ruling until April 2020.

However, in a recent development, the husband was surprised to find his bank accounts frozen by the Enforcement Court for a sum of BD15,305, attributed to the support payments.

The enforcement file, which had been inactive since 2014, was suddenly reactivated in March 2023, prompting the husband to file an appeal.

The husband’s lawyer argued that the wife had failed to provide sufficient evidence to prove that he had not been fulfilling his financial obligations, particularly considering the lapse of time since the initial ruling and the nearly decade-long dormancy of the enforcement file.
