The High Civil Court has ruled in favour of a motorcycle rider, awarding him 6,000 Bahraini dinars in compensation from an insurance company and the driver of a car who caused him a 15% permanent disability. The court also ordered both defendants to jointly pay court costs, legal fees, and expert fees.
The plaintiff's lawyer, Zainab Madan, stated that her client was riding his motorcycle when he was involved in a traffic accident caused by the driver of the car, who was subsequently found guilty in a criminal court. The accident resulted in various injuries to the plaintiff, with the medical board assessing his permanent disability at 15% of total disability.
Madan emphasised that the second defendant's insurance company was liable for the accident caused by its insured, the first defendant, based on Article 2 of Decree-Law No. 3 of 1987 concerning compulsory insurance for civil liability arising from vehicle accidents. This article mandates that insurance policies cover civil liability for bodily and material damage resulting from vehicle accidents occurring in Bahrain.
She further cited Article 12 of the same law, which states that coverage for civil liability arising from vehicle accidents includes the insurer's obligation to pay compensation for the death of any person or any bodily injury sustained by any person.
Therefore, the court found that the driver and the insurance company were liable for the damage caused to the plaintiff. The court ruled that the defendants must jointly pay the plaintiff 6,000 dinars in material and moral compensation and court costs, 100 dinars for legal fees, and 90 dinars for expert fees.
