Young woman’s divorce from first husband ‘never officially finalised’

In a case reminiscent of a film plot, a young woman discovered three years after her divorce from her first husband and the birth of two children with another man, that her divorce was never officially finalised. This revelation forced her to seek legal recourse to secure her divorce and establish the paternity of her children.

As detailed by lawyer Aisha Flamarzi, her client married her first husband in 2017. The couple divorced in 2020 after three years of marriage, with the husband forcing her out of the marital home.

All contact ceased between them. In 2021, the woman entered into a temporary marriage contract with another man for a period of nine years, with a dowry of BD50.

Marriage Two years later, she gave birth to her first child, followed by a second child in 2023. It was during this time that she formalised her marriage with the second man.

Flamarzi explained that her client approached official authorities to complete the necessary paperwork for her children and obtain birth certificates.

However, she was stunned to learn that the divorce from her first husband had never been officially finalised.

Unable to contact her former spouse, she filed a lawsuit seeking a divorce on grounds of harm, which was granted in 2023.

She also filed a lawsuit to establish the paternity of her children. Lawsuit The court ruled that the woman was officially divorced from her first husband on August 17, 2023. Subsequently, a lawsuit was filed in the Supreme Sharia Court to establish the paternity of the two children.

DNA samples were collected from the mother, the children, and the alleged father.
