The High Appeals Court has upheld a two-year prison sentence for a man and one-month sentences for his two friends following an assault that occurred at a nightclub. The incident, which took place in the early morning hours at the nightclub, began with a verbal altercation between the three defendants and two victims.

According to court documents, the altercation escalated into a shouting match, prompting the intervention of security personnel to de-escalate the situation. However, as the victims were leaving the club, the third defendant physically assaulted the second victim, resulting in injuries including swelling in both ankles, bruising on the right thigh, abrasions on the right pinky finger, and a cut on the upper lip.

Simultaneously, the first defendant grabbed the first victim from behind, lifted him, and forcefully threw him to the ground. The second defendant then kicked the victim while he was lying on the ground.

The fall caused the victim to lose consciousness and suffer a skull fracture with internal bleeding, a subdural hematoma, and a lateral displacement of brain tissue. He underwent surgery to reposition the brain tissue, resulting in a 10% disability.

During the investigation, the first defendant admitted to grabbing the victim from behind but claimed he intended to break up the fight and that the victim fell due to his own movement. The second defendant confessed to kicking the victim after the first defendant had lifted and dropped him. The third defendant acknowledged assaulting the second victim.

Security footage corroborated the accounts, showing the first defendant lifting and dropping the victim, followed by the second defendant running towards the fallen victim and kicking him.

The court, considering the severity of the injuries and the defendants' confessions, upheld the initial verdict, sentencing the first defendant to two years in prison and the other two defendants to one month each.
