A Sharia Court has denied a husband’s request for his wife to return home, citing his violent demands for her to consume alcohol as the reason for her departure.
The court found that he had broken her arm in the process. Lawyer Taqi Hussain, representing the wife, noted that the husband filed the case based on their legal marriage, arguing that an official marriage certificate legitimised his demands.
Reconciliation However, mediation by the Family Reconciliation Office determined that reconciliation was impossible.
During the hearings, the court examined the wife’s claims that she left due to her husband’s lack of trust and coercive behaviour regarding alcohol.
Witnesses supporting her testimony detailed the assault and her hospitalisation for a broken arm.
Relationship Conversely, the husband’s witnesses denied any conflict, asserting that their relationship was healthy.
Citing Article 54 of the Family Law, which permits a wife’s refusal to return if her husband is untrustworthy or fails to provide necessary support, the court ruled in favour of the wife.
It dismissed the husband’s case and ordered him to cover court fees and legal costs.
