Higher compensation joy for daughter’s disability

A mother secured a significant legal victory after the Third High Court of Appeals increased her compensation from BD1,300 to BD2,000. The compensation was awarded following a tragic traffic accident that left her daughter permanently disabled.
The court also determined that both the insurance company and the driver must cover legal fees and translation costs, affirming the family’s right to compensation for the emotional turmoil inflicted by the incident. Lawyer Zahra Naama, representing the victim’s family, laid bare the harrowing circumstances surrounding the case.
The young woman suffered a permanent disability of 10% due to severe injuries to her left ankle and fractures in two bones of her heel, which required surgery.
The driver was found guilty in relation to the incident, leading the family to pursue legal action for both financial and moral redress.
Initially, the first-instance court ordered the insurance company and the driver to pay a total of BD5,300 to the plaintiffs, but it denied any compensation to the victim’s mother. Displeased with this outcome, the plaintiffs decided to appeal.
Naama has since called for a revision of the ruling, urging the court to compel the defendants to cover the victim’s medical expenses resulting from the accident and to raise the compensation for each plaintiff to BD500, rather than the BD300 previously awarded by the first-instance court.
This case encapsulates the legal hurdles families face in their pursuit of justice, revealing the emotional and financial strains they must navigate in the aftermath of such life-changing events.
