Homeowner wins BD2,625 after decor shop fails to deliver

A homeowner won BD2,625 in a court after a decor shop failed to deliver promised interior design work, leaving his flat with bare walls and empty rooms.
The ruling, confirmed by his lawyer, Taqi Hussain Taqi, mandated the shop to pay this amount.
The homeowner had contracted the defendant for the supply and installation of decor at a cost of BD5,800, with the understanding that the project would be finished within a month.
Legal recourse
After paying BD3,000 upfront, the contractor failed to fulfil the terms, leading the homeowner to seek legal recourse following several unsuccessful attempts to resolve the matter directly.
Taqi explained that a review of the agreement revealed that certain tasks had been cancelled, reducing the contract value to BD2,500.
This adjustment was intended to help the contractor complete the project, leaving a balance of B500 owed.
However, when the contractor still did not meet his obligations, the homeowner issued a final notice before filing a complaint with the Consumer Protection Directorate and the Capital Police.
The court found that the homeowner had sued the defendant’s sole proprietorship, which did not possess a separate legal identity from its owner, making the dispute a personal matter.
As a result, the homeowner sought to terminate the contract and compel the defendant to refund the BD3,000, along with compensation for the distress caused by the contractor’s failure to deliver.
