The High Civil Court has ordered an insurance company to pay BD36,000 in compensation to the family of a 17-year-old boy who died in a traffic accident.
The ruling comes after the victim’s family chose to forgive the 19-year-old driver responsible for the accident, opting instead to pursue legal action against the driver’s insurance company.
According to their lawyer, Dr Mohammed Al Kooheji, the family, consisting of six members, filed a civil lawsuit against the insurance company after the criminal charges against the driver were dropped due to a reconciliation agreement.
The court ’s decision hinged on the insurance company’s liability under the mandatory motor vehicle insurance law.
The court heard testimony detailing the severity of the injuries sustained by the victim, including near-complete amputation of an upper limb and fractures to the skull and rib cage, as stated in the death certificate. The court recognized the pain suffered by the victim.
