Tougher penalties for selling herbal smoking substitutes

Sellers of herbal alternatives to tobacco could face up to a year in jail or a fine of up to BD1,000 under new rules aimed at curbing smoking in public spaces, including barber shops and parks. The tougher penalties come as the government seeks to close loopholes in the country’s anti-smoking laws, targeting not only traditional tobacco products but also herbal or non-nicotine substances used as substitutes. Punishments now include up to a year in jail or fines ranging from BD100 to BD1,000 for anyone caught importing, selling, or distributing these alternatives.

Additionally, a further fine of BD20 to BD50 will be imposed on those who violate the ban on smoking in indoor public spaces. This includes locations such as transport hubs, airports, government offices, hospitals, schools, and barber shops — along with other places designated by the minister. Courts have also been granted the power to shut down businesses for up to three months or confiscate materials involved in any violations.

These amendments to Law No. 8 of 2009, which regulates all forms of tobacco use, have already been submitted to the Council of Representatives for review. Furthermore, selling cigarettes individually or distributing tobacco products to minors under 18 will now result in a BD100 fine.
