Building Company Ordered to Pay 13,495 Dinars for Shoddy Villa Project

A court has ordered a construction firm to pay 13,495 Dinars to a homeowner over a dream villa left half-done, plus 747 Dinars for expert fees and legal costs.

The homeowner, pursued legal action after construction delays left their villa incomplete, despite having paid 49,200 Dinars toward the agreed price of 61,500 Dinars. Only 39,905 Dinars’ worth of work had been completed, leading the client to seek both a contract termination and financial redress for the unfinished work and defects.

Lawyer Taqi Hussain represented the homeowner, presenting key evidence, including the original contract, payment records, and an expert report confirming the substandard work. The homeowner’s claim was detailed with demands for 9,295 Dinars for uncompleted work, 9,660 Dinars in penalties for delays, 2,700 Dinars to address defects, and 374 Dinars for a report on structural issues.

Correspondence revealed that the builder had agreed to a daily penalty of 20 Dinars if the project missed the revised completion date. While the court supported most of these claims, it adjusted the delay penalty to 1,500 Dinars, given the partly completed state of the work.

The final award of 13,495 Dinars covers excess payments made for incomplete work and other related damages. The court dismissed a claim for moral damages, noting that Bahraini law does not permit dual compensation, as the delay penalty already addresses the matter.

Additionally, the judgment orders the builder to cover 747 Dinars for expert and report fees, along with 20 Dinars in attorney fees. Court fees were assessed at 616.5 Dinars, with 340.5 Dinars payable to the homeowner and a 10 Dinar execution fee imposed on the firm.
