Man Left Homeless After Transferring Marital Home Title to Wife Wins BD12,000 in Court

A 60-year-old man’s life took a dramatic turn when transferring the title of his marital home to his wife led to his eviction after 30 years of marriage. Despite contributing over BD10,000 to the property's purchase and maintenance, the man found himself homeless, alternating between hotels and his married children's homes.

Following his divorce, the man turned to Bahrain's Civil Court, which ruled in his favor, ordering his ex-wife to pay nearly BD12,000 as compensation for financial and moral damages, as revealed by lawyer Abeer Al Anzi.

Legal Battle and Eviction

The case details indicate that the ex-wife filed for divorce in the Sharia Court, which granted the divorce and included a settlement requiring the husband to receive BD2,000. However, after the court’s decision, the wife evicted him from the marital home, denying him access and threatening police action if he tried to return.

This forced eviction caused significant financial harm, including the cost of temporary housing. The man also endured emotional distress due to the threats and loss of his home, even as his appeal against the divorce ruling was rejected.

Contribution to Marital Home

An expert report presented in court showed that the man contributed BD10,425 toward the home’s purchase and related expenses. Evidence included a BD9,000 down payment made in 1993, acknowledged by the wife in a WhatsApp message, and additional receipts for property appraisal, construction of an external room, and registration fees.

While some payments lacked documentation, the husband sought an oath regarding the amounts and requested compensation for his damages.

Court’s Verdict

The court ruled in favor of the man, acknowledging his BD10,425 contribution and the BD945 paid for property registration fees. Testimonies from the couple’s children supported his claims, confirming his financial input for the room's construction.

The court ordered the ex-wife to repay the full amount, bringing some justice to the man after years of financial and emotional hardship.

This case highlights the importance of documenting financial contributions in marital agreements and the legal avenues available to seek redress in the face of injustice.
