High Civil Court annuls eight-year property sale

The High Civil Court has ruled in favour of a plaintiff in an eight-year-old property dispute, annulling a sale agreement and restoring full ownership of a house. The court’s decision, detailed by lawyer Hussain Salem, hinges on the defendant’s failure to provide proof of payment for the agreed-upon purchase price of BD 100,000.

The court has ordered the Land and Survey Department to amend the property title deed, transferring complete ownership back to the plaintiff. According to Mr Hussain, the plaintiff’s lawyer, the case arose when the defendant, the plaintiff’s former spouse, filed a lawsuit seeking to claim half-ownership of the property.

The defendant based his claim on a sale agreement allegedly made through a power of attorney granted to their children for the management and disposal of the property. However, Mr Hussain argued that this power of attorney was exceeded, constituting misuse without the plaintiff’s knowledge or consent.
