Legal battle over BD30,150 in three bounced cheques

Three cheques worth BD30,150 bounced, spurring a courtroom showdown that ended with a real estate firm and its representative being ordered to pay up.

The ruling draws a line under a dispute that began with lofty promises of incentives in a property deal but unravelled after the cheques were returned unpaid.

The plaintiff, who bought property from the firm under a signed agreement, said the cheques — dated 1 December 2023, 1 March 2024, and 1 June 2024 — were meant as part of the agreed rewards.

However, when presented to the bank, they were dishonoured.

Despite repeated efforts to recover the money, including legal notices from his lawyer, the firm failed to make good on the payments.

With no resolution in sight, the plaintiff turned to the courts, filing the case electronically on 26 September 2024.

His evidence included a copy of the sales agreement, the bounced cheques, proof of legal notices served to the firm, and their commercial registration.

little defence The defendants, however, provided little defence and failed to dispute the evidence or offer proof of repayment.

In its ruling, the court stressed that under Bahraini law, a cheque serves as evidence of a debt unless its authenticity is openly contested. The plaintiff, the court ruled, had provided enough proof of the debt.
