Motorcycle Helmet Assault Results in Suspended Sentence

A 23-year-old Asian man has been sentenced to one year in prison, suspended for three years, for assaulting a security guard at a shopping mall.  The High Criminal Court handed down the sentence, citing the victim's withdrawal of his complaint and the defendant's lack of prior convictions as mitigating factors.

The incident occurred when the security guard asked the defendant to move his motorcycle away from a gas storage area.  The defendant, angered by the request, responded by striking the guard three times on the left hand with his motorcycle helmet.  
 
The assault resulted in a fractured pinky finger and a 1% permanent disability, according to a forensic medical report.  The report also indicated the injury required over 20 days of treatment.

The court, in its ruling, referenced Articles 72, 81, and 83 of the Bahraini Penal Code. Article 72 allows for the suspension of sentences based on the circumstances of the case.  Articles 81 and 83 pertain to judicial discretion in sentencing and the consideration of mitigating circumstances.  
 
The judge stated that the victim's decision to withdraw his complaint, coupled with the defendant's clean record and the belief he was unlikely to re-offend, led to the suspended sentence.

The defendant confessed to the assault during the investigation.  The suspended sentence means the defendant will avoid prison time unless he commits another crime within the three-year probationary period.
