Court Awards Family BD 5,200 After Child Loses Tooth in Accident

A Bahraini court has awarded a family BD 5,200 in compensation following a traffic accident that resulted in an 11-year-old boy losing a tooth. The Civil Court held both an insurance company and the driver responsible for the November 2022 incident.

The ruling, detailed by lawyer Zahra Hussain, includes BD 3,000 for the child's dental injury, along with additional compensation for his father and sister who also sustained injuries.

According to Hussain, the accident occurred due to the negligence of the first defendant, who was driving a vehicle insured by the second defendant. A criminal court previously fined the driver for their role in the accident. The family subsequently filed a civil suit seeking compensation for both physical and emotional damages.

The court's judgment detailed the injuries sustained by each family member. The mother (second plaintiff) suffered soft tissue injuries to her right hand, leg, and neck, resulting in intermittent pain. A medical report assessed her permanent disability at 2%, leading to a BD 1,000 compensation award for physical damage and a further BD 500 for emotional distress.

The 11-year-old son (first plaintiff) sustained injuries to his left leg, superficial abrasions, and a fractured upper incisor (tooth #11). He also suffered a laceration to his upper lip and a 1cm scar on his lower lip. The court noted the need for a temporary replacement tooth and eventual implantation of a permanent tooth #11, costs the at-fault party will cover. The medical report assessed his permanent disability at 5%, resulting in a BD 2,500 compensation award for physical damage and BD 500 for emotional distress.

The father (first plaintiff) received BD 500 for emotional distress caused by witnessing his wife and son's injuries and experiencing the accident himself. His daughter (first plaintiff), the injured boy's sister, received BD 200 for emotional distress.

In total, the court ordered the defendants to pay the father BD 3,700 (BD 500 for himself and BD 3,200 on behalf of his son and daughter), and the mother BD 1,500, totaling BD 5,200 in compensation.
