Bahraini Woman Ordered to Return Dowry After Refusal to Return to Marital Home

The High Sharia Court has ordered a woman to return her full dowry of 4,000 Bahraini dinars after she refused to return to her marital home without legal justification.  The ruling follows a previous court order compelling her return, which she ignored.

According to lawyer Noura Talal Bu Wardah, her client, the husband, initially filed a case against his wife for refusing to return to the marital home after leaving approximately two years into their marriage.  The Sharia court ruled in the husband's favour, ordering the wife to return.  This ruling became final when the wife did not appeal.

Despite the court order, the wife persisted in her refusal to return.  The husband subsequently sent her numerous letters and engaged mediators, but she remained adamant in her decision.  Attempts at reconciliation through the Family Reconciliation Office also failed due to the wife's absence.

The husband then filed a second lawsuit seeking a divorce and the return of the dowry, which included the mahr (bride price) and the shabka (jewelry given as a gift).  The court considered the wife's continued refusal to comply with the previous court order, her failure to fulfill her marital duties, and the lack of any legitimate reason for leaving the marital home.

Article 54A of the Bahraini Family Law states that a wife forfeits her right to financial support if she refuses to move to or leaves the marital home without a valid reason, or prevents her husband from entering without a valid reason.
 
Based on this law, and the wife's actions, the court granted the husband a divorce and ordered the wife to return the full dowry of 4,000 Bahraini dinars.  The court also awarded the husband legal fees.
