The High Criminal Court has officially recognised a settlement between a gold trader and a female customer after she withdrew her complaint regarding a delay in the delivery of a gold piece. The ruling came after the customer, who had initially filed a complaint against the trader for not providing the agreed-upon item on time, decided to resolve the issue amicably.
According to attorney Adnan Majid Al Owainati, the Public Prosecution had charged the trader (his client) with misappropriating funds belonging to the complainant. The case emerged when the complainant reported to the Economic Crimes Division that she had arranged to buy a gold piece for 640 dinars through an Instagram account operated by the trader.
Following their agreement, she transferred the payment via a financial application and was supposed to receive the item within 14 days. However, the trader was unable to fulfill the order within the stipulated timeframe, prompting the customer to file a complaint.
In the subsequent investigation, the trader explained that he runs an Instagram account specialising in women's gold accessories and luxury watches. Customers typically contact him through WhatsApp or Instagram to place orders.
The complainant had reached out to him for the gold piece, and upon their agreement, she sent the payment to his bank account. Unfortunately, he required more time than initially agreed, leading her to request a refund. When he declined, she opted to escalate the matter legally.
After the case was presented in court, the defendant acknowledged his responsibility for the situation. Attorney Al Owainati submitted a defense memorandum along with a formal withdrawal of the complaint from the claimant, requesting the court to acknowledge the settlement.
