Lawyer jailed for false police report against former trainee

The Court of Cassation upheld a six-month prison sentence for a former trainee charged by his employer, a lawyer, with filing a false police report to prosecution following a wage dispute.
The court rejected the defendant’s appeal to overturn the earlier jail term, issuing a decisive ruling that concluded a protracted legal battle stemming from a seemingly minor workplace dispute.
The case originated from a disagreement between a lawyer and his junior at the law firm. The dispute centered on the trainee’s salary.
Payments
When the trainee pursued legal action to recover what he believed to be rightfully owed wages, the court ruled in his favour, awarding him the outstanding payments.
Instead of accepting the court’s decision, the lawyer responded by filing a report with the Public Prosecution.
This report contained serious allegations, falsely accusing the trainee of forging his employment contract and submitting it to the Social Insurance Organisation (SIO) for registration purposes.
Furthermore, the lawyer alleged that the trainee forged a certificate of experience and presented it to the Registrar General’s office at the Ministry of Justice.
Falsity
A thorough investigation by the Public Prosecution uncovered the falsity of these claims which intended to damage the trainee’s reputation and cause him significant harm.
Following the investigation, the lawyer was formally charged and brought to trial. The initial trial in a lower court resulted in an acquittal for the defendant.
However, the Public Prosecution appealed this decision, and the High Appeals Court reviewed the case and overturned the acquittal, finding the defendant guilty and imposing a six-month prison sentence.
Verdict
The defendant subsequently challenged this verdict, leading to another appeal hearing before the High Appeals Court.
