A former employee has lost a legal fight over unpaid sales commissions, with the court ruling she had not followed the company’s procedures to claim them.
Her former employer argued she had been paid commissions when she adhered to the process and accused her of submitting a falsified document to back her case.
The worker, who left the firm after eight months, said she was entitled to commissions for that period and claimed it was standard practice for those in her role.
Lawsuit
She lodged a lawsuit seeking payment for commissions she said had not been settled at the end of her contract.
Lawyer Aziza Al Bastaki said her client wanted the case referred for further inquiry before a final ruling, aiming to establish that the company routinely paid commissions to employees in her position.
She sought a ruling requiring the employer to pay her outstanding dues.
Payments
The company’s legal team rejected the claim, arguing the worker had failed to prove her right to the payments.
They dismissed the commission schedule she provided as fabricated and unverified, pointing out it bore no company stamp or authorising signature.
The court referred the case for further examination, allowing the firm to present evidence that the worker had not met the conditions for receiving commission payments.
She was also given the opportunity to challenge the claim.
Two company witnesses told the court the plaintiff had worked for the firm but had not followed the process required to qualify for commissions.
