Man wants firm to cancel his resignation, Court denies

Manama: A court rejected the case of an employee who sued his former employer for 'accepting his resignation'. He submitted his resignation while he was 'under pressure and frustrated'.

“I was hired in 2008 as an accountant in the company. Later I was surprised at the management’s decision to promote my colleagues and increase their salaries, though I was also entitled to get promotion considering my performance,” the plaintiff told the court.

“I appealed to the management about this, but my complaint fell on deaf ears. Thus I submitted my resignation, but it wasn’t my desire to do that,” he added.

However the court ruled in favour of the employer. It said that the management of any company held the rights to promote and not to promote any of their employees based on its evaluation of their performances and the interests of the company.

“The plaintiff was working as a supervisor and the case documents came free of anything proves that the employer promoted any of his counterparts. Moreover, the local labour laws allow employees to hand their resignation in the event they want to be relieved from their duty. The employer has the right to accept or reject it. In this case, the employer accepted it, therefore the court cannot force the company to reinstate him,” the court ruling read.
