Court orders man to pay ex-wife BD190 in monthly alimony

The Minor Sharia Court (Jaffaria Section) has ordered a father to hand over the passport, birth certificate and identity card of his eight-year-old son to his ex-wife. According to the defence attorney, Sara Ali, the couple got married on May 22, 1991, and decided to separate on January 15 last year, after “living with each other as husband and wife became difficult”. Ms Ali explained that the couple have a 23-year-old daughter in addition to their younger son.

The lawyer said the court ordered to give custody of the child to the mother on June 6, 2018, and that the mother has been the legal custodian of the boy since then. But, Ms Ali also said that the alimony was the responsibility of the father as stipulated by Article 131 of Family Law 19 of 2017. However, the father didn’t pay alimony to his ex-wife and refused to hand over the boy’s legal documents to her throughout one year, despite repeated requests from the woman.

Ms Ali added that the woman sought justice from the court as she was unable to complete legal and formal procedures without obtaining the documents from her ex-husband. The lawyer also revealed that the court additionally ordered the man to pay BD190 in monthly alimony since October 1, 2018.
