Woman given divorce after hubby rapes her nephew
The High Shariat Appeals Court has granted divorce to a woman from her husband after he allegedly raped her nephew. The woman, in her twenties, lodged a divorce plea after the High Criminal Court found him guilty of crime. However, the man was not willing to separate from her, describing her reason as “silly one”.
The woman’s case was earlier rejected by the High Shariat Court, which stated that both matters are different. Nevertheless, she insisted to have her wish met and appealed the ruling. Her lawyer Fatima bin Rajab proved to the court that the incident caused deep mental harm to the woman and divorce remains the only solution to cure psychological damages she suffered.
“It’s impossible for her to continue her life with him after he raped her sister’s son 20 times by threatening him. It damaged her psychologically,” the lawyer told the High Appeals Shariat Court.
The High Appeals Shariat Court agreed with the provided reasons and granted her divorce, pointing out it was impossible for her to continue life with the rape accused.
