The Ninth Urgent Matters Court has ordered to immediately evict an investor from land in Jidhafs that belongs to Al Shabab Sports Club. The case was initiated by the club against the investor, who signed an agreement to construct a building on the abovementioned land and to pay a monthly rent of BD4,140.
However, the investor has failed to pay the agreed amount since September of last year and did not construct the building, which was mentioned in the agreement and which was supposed to consist of 23 commercial outlets.
The Plaintiff’s Attorney Mohammed Al Mahdi explained that his client, the club, decided to evict the investor as per court order, therefore a complaint was submitted to the Urgent Matters Court. The lawyer said clause 16 of the agreement stipulated that it shall be cancelled immediately and automatically with the force of the law in case the second party, the investor, does not comply with the completion of the building construction for it to be suitable for operation within a year from the issuance of the building permit.
Al Mahdi also clarified that the agreement is considered invalid if the investor did not pay the value of the investment by the due date, adding that the court announced its verdict to immediately evict the investor as he clearly violated the terms and conditions mentioned in the agreement.
