The Ministerial Committee for Development and Infrastructure Projects has referred five real estate projects built prior to the issuance of the regulation of the real estate sector law 27 of 2017 to the Judicial Committee for the Settlement of Stalled Real Estate Projects.
Deputy Prime Minister Shaikh Khalid bin Abdullah Al Khalifa, also head of the ministerial committee, said that the decision was taken in a virtual meeting after the ministerial committee reviewed the projects of Breeze Seef, Marina Breeze 1 and 2, Dar Al Ezz 2 and 3, Marina Reef and Al Areen Homes.
The projects were referred by the Cabinet in early May to the committee through an inventory of obligations and rights, and access to all data, information, relevant documents.
“It became clear to the Ministerial Committee that in the Marina Reef project, whose units were sold off-plan in conjunction with the start of its construction in 2007, the units were not delivered to their owners at the specified time,” Shaikh Khalid said.
As for the other projects, the units were sold off-plan before the issuance of law 27/2017, and the buyers fulfilled part or all of their financial obligations to the developers.
The developers mortgaged the projects, during or after the construction and before the delivery of the units, preventing the owners from receiving their property deeds.
This meant they could not establish owners’ syndicates to ensure the proper use of the common property and real estate units, and the use and maintenance of shared areas.
Bahrain is a state of institutions and law under the leadership of His Majesty King Hamad bin Isa Al Khalifa, and through the efforts of the government, headed by His Royal Highness Prince Salman bin Hamad Al Khalifa, Crown Prince and Prime Minister.
“We are very keen to protect the rights and interests of individuals in all cases and by all means, especially the legal ones, which has proven the integrity of the government’s approach in dealing with stalled real estate development projects, in accordance with Decree-Law 66 / 2014 regarding the settlement of stalled real estate development projects,” Shaikh Khalid said.
Since the implementation of the provisions of Decree-Law 66 / 2014, decisions have been taken on eight stalled projects based on complaints from the owners, with the settlement of five.
In this regard, and in order to address all stalled real estate development projects, Shaikh Khalid directed the Real Estate Regulatory Authority (RERA) in coordination with the relevant ministries and government agencies, to inventory and follow up projects sold off-plan before the issuance of the real estate regulation law in 2017
