HM the King amends dispute resolution law

His Majesty King Hamad bin Isa Al Khalifa yesterday amended some provisions of Decree-Law No. (30) of 2009 regarding the Bahrain Chamber for Dispute Resolution.
Accordingly, article 9 of the law now gives the Chamber the jurisdiction to adjudicate disputes, which falls under the purview of a Bahrain court or any other body, whenever the value of claims exceeds five hundred thousand dinars, except in reorganisation and bankruptcy cases.
The Chamber will have a say in disputes between financial institutions licensed by the Central Bank of Bahrain Law or other institutions, companies and individuals.
The decree also amends law on commercial disputes, saying that it shall be international if one of the parties or places related is outside the Kingdom. It also defines the disputes that have commercial nature or between commercial companies.
Article (31) of the law now allows a judge delegated by the Supreme Judicial Council to issue the orders and decisions necessary to settle an issue that requires judicial intervention. Such orders, the amendment says, should be considered as orders and decisions issued by the dispute resolution tribunal.
A person concerned may file a grievance against the order or decision before the judge who issued it or before the Dispute Resolution Committee after its formation. However, the decision issued in the grievance cell will be final and not subject to appeal.
