Bahrain court rejects company embezzlement case against employee

The High Labour Court rejected a lawsuit filed by a company against a former employee, claiming that he owed an amount of BD6,800 to it. The court cited insufficient evidence in its decision.

It ordered the company to pay the costs of the case and annulled a travel ban order that was issued against the worker.

As per the court records, the employee’s lawyer, Zuhair Abdullatif, explained that the company had filed a lawsuit before the Labour Court, in which it said that the defendant had BD6,806 in his possession that belonged to the company.

The company claimed that this amount represents the value of customers’ dues that includes commissions that he unlawfully received from one of its suppliers, which violates its policy.

The company requested that he be obligated to pay the amount of the claim and a 10% interest rate of the due date and banned him from travelling.

The case was lodged one year after the date of the defendant’s transfer to another company.

The defendant’s lawyer pleaded the statute of limitations for the case, as one year has passed since his client had left the company and moved to work for another company.

Moreover, the defendant’s attorney demanded that the lawsuit be dismissed because it was not based on reality and the law and said that the company did not provide documents that prove its claim.

The court also obligated the company to pay the legal expenses and attorneys’ fees.
