Bahraini woman asks for divorce owing to husband’s strange requests

A woman resorted to the Sharia Court after she refused to comply with her husband’s requests and was afraid of crossing the limits set by God. She demanded a divorce which the Court finally approved after several witnesses confirmed her allegations.

The plaintiff’s lawyer, Dr Mohahmmed Al Kooheji, said that his client, a 20-year-old Bahraini national, got married less than two years ago, but she suffered following her husband’s desertion for months in addition to refusing to cover her expenses which made her rely financially on her family.

He added, during his closing argument, that he had verbally and physically assaulted her because of her refusal to meet his requests which were crossing what he described as the limits set by God and human nature. “As a result, she resorted to the court for divorce,” he stated.

Before ruling in the case, the Court decided to refer it for investigation and to hear witnesses from both parties. It established that the defendant was accustomed to beating her, and he confirmed this on several occasions, stating that he deserted her for five months, during which he sent to her only BD50.

In the grounds of the judgement, the Court said that the decision was made in accordance with Article 98 of the Family Code which allows the wife to request a divorce on the grounds of harm that makes it difficult for her to continue living with her husband or in the event her husband deserts her completely and leaves her in the balance without an excuse.

It added that the plaintiff filed her lawsuit and asked for a divorce on the grounds of harm, and proved that the defendant deserted her intermittently and refused to cover her expenses as well as he beat her constantly and asked her for requests that violate God’s law and instinct. “The Court established the validity of the women’s claims, and it decided to meet her request for divorce,” the Court stated.
