Court orders showroom to refund BD5,300 to customer for selling defective car

The High Appeals Court has ordered a car showroom to refund a customer BD5,300 after it was found out that the car he had purchased from them was initially cancelled due to a traffic accident, and later repaired and shipped to Bahrain.
In its ruling, the court stated that the seller withheld essential information from the customer, regarding the car’s issues.
An expert evaluated its value at just BD2,700, although it was sold for BD5,300. Problems began to emerge since the plaintiff began using the car.
He contacted the car showroom owner who refused to refund him the amount. According to the verdict, the car had a major defect that was difficult to identify and required an expert as well as thorough examination.
To make matters worse, the car’s papers did not include such information, which impacts the price and its condition. Consequently, the court ruled in favour of terminating the contract and refunding the plaintiff.
