A government employee, who received BD20,000 as a grant for continuing his studies abroad, will now have to refund that amount to his organisation for failing to comply with contract terms. The High Appeals court passed the judgement rejecting a challenge filed against a court order issued earlier in the case.
Court files say the organisation decided to move the Court after the employee left his post without completing the agreed duration. The defendant, the organisation said, citing existing laws, was supposed to serve double the duration he spent abroad. However, the man resigned after getting his educational costs covered.
The plaintiff requested the Court to reject the case, citing the statute of limitations and arguing that five years have passed since he left the job with the organisation. However, the Court rejected this pointing out that the statute of limitations is applicable only after 15 years of the incident.
The organisation indicated in its court filing that they sent the defendant abroad to continue his education while he was working with them. However, he left after receiving the grant forcing the company to file a case for recovering BD20,000 citing contractual violations. The court files showed that the defendant paid BD8000.
