Court orders legal heirs to settle debts of deceased company owner

The Third high Commercial Court yesterday ordered the legal heirs of a deceased company owner to clear the cheques he signed for BD8040 and presented to another company before passing away. The Court also ordered the defendants to pay the plaintiff a 1% interest on the owed amount from the due date.
The Court also ordered the defendants to pay the plaintiff BD268,500 towards lawsuit expenses and BD20 attorney fees. Case files say the company owner had signed and presented two cheques for BD8040 to another company in return for some commercial before his death.
However, when the company presented the cheques for collection, the cheques got bounced. The defendant notified the company heirs of the cheques but failed to get a positive response. Further investigators ordered by the Court found out that the company owner had died and the defendants were the legal hair based on his legal heirship certificate.
After the defendants turned out as the heirs of the defendant, authorities asked them to fulfil the claim. The Court confirmed in the verdict that the deceased’s property becomes heritable only after paying his debts. The remaining property, movable or immovable, is heritable, as per Islamic Sharia law.
