The Shariat Appeals Court has rejected the case filed by a husband to force his wife to return to their home, citing ill-treatment. According to court files, the woman left her husband’s home due to continued physical assault and insults.
The husband had earlier won the case which was heard by the Court of First Instance as it ruled for having the wife return to the marital home. But the Appeals Court overturned the first-degree judgment and dismissed the case.
The Court heard the witnesses of both sides before deciding on the wife’s appeal. The first witness alleged that he had personally witnessed the husband beating the woman for over 30 years. “One of the incidents happened before the eyes of her family. I also spotted the husband on several occasions with foreign girls,” the witness said.
Interestingly, one of the husband’s sons also testified against him, telling the Court that his father has extramarital relationships with foreign women, with whom he has sex too. “I hear him talking about sex and love. Most of them are married too. He has some relationships with domestic workers too,” the son said.
The Court pointed out in its ruling that it wouldn’t be safe for the woman to return to the house and live with the husband based on the testimonies provided. “He isn’t trustworthy to have his wife living with him,” the court’s ruling stated.
