The High Sharia Court obligated a 50-year-old man to pay his ex-wife, who is in her twenties, BD3,250 for divorce alimony. The Court confirmed that alimony is mandatory for the divorcee as long as the husband filed for divorce for no reason other than to reconsider her or without her request for the divorce.
The woman’s lawyer said that his client married the defendant in a European country and then filed for divorce without paying alimony. As a result, she appealed to the Sharia Court to enforce her legitimate rights, especially when the divorce was initiated by his own free will and she did not request or be the reason for it. T
he lawyer filed another lawsuit, claiming alimony for her waiting period, stating the divorced woman’s lawful rights under Sharia and Family Provisions Law.
The Court affirmed that the divorcee is entitled to alimony if the divorce is without reason and that the amount is estimated for a one-year period as stated by the divorcer, the duration of the marriage, and the circumstances of the divorce.
It confirmed that the divorcee shall be provided for equitably, since she is divorced without her consent, without requesting it, and with no reason.
