Hotel employee acquitted of embezzlement charges

The High Criminal Court of Appeal acquitted a man, an employee of a well-known hotel resort, of embezzling 42 dinars from the resort’s swimming pool and beach fees.

The resort administration had accused him of stealing based on the testimony of witnesses, but the Court of Appeal found that the incident took place in a different manner than presented by the witnesses.

The court ruled in favour of the appellant’s defence, stating that there was no weight to the whistleblower’s story and preferred the appellant’s argument.

The resort owners had said the employee handed them only 189 dinars on that day, which was collected from nine customers.

There, however, were 11 customers using the resort facility, whose fees counting to BD42 were missing.

The Court of First Instance had initially sentenced the man to one month in prison, ordered him to return BD42 to the company and signed his deportation after jail term.

Overturning that verdict, the Court of appeal viewed that there was no solid proof to the resort’s claim, as only nine people were in their registry.
