A Bahraini woman obtained a divorce from her GCC husband after nine years of separation. The couple were legally married and had two daughters.
However, the husband abandoned her in 2014 without justifiable reason, causing severe psychological and financial distress, said her lawyer.
The lower court ruled in favor of the woman, citing his failure to provide financial support and extended abandonment as grounds for divorce. The woman filed an appeal, seeking a favorable judgement and appropriate legal remedies.
The appeal process involved a formal hearing, investigating the damages caused by her husband through witness testimonies, and seeking the annulment of the previous ruling.
The court found witness testimonies to be compelling evidence of the husband's abandonment and its detrimental impact on the woman. The court recognized the husband's abandonment as a clear case of marital harm, warranting the granting of a divorce.
The couple had entered into a valid religious marriage, with no previous instances of divorce, and the court recognized the husband's abandonment as a clear case of marital harm.
