BD11,000 compensation awarded to Asian victim in road accident case

The High Civil Court has ordered an insurance company and the driver of a vehicle to compensate an Asian victim with a sum of BD11,000. The decision comes after the insured driver, belonging to the insurance company, collided with the victim, causing severe injuries and permanent disability assessed at 20% by medical committees.

According to the victim’s lawyer, his client was riding his bicycle on a street in Salmabad when he was unexpectedly hit by a speeding car. The collision resulted in the victim being dragged for more than 15 meters, causing serious injuries.

The medical report revealed fractures in the front and back bones, which were treated conservatively. Additionally, the victim suffered persistent pain at the site of the injury, along with two scars measuring 12 cm and 18 cm resulting from surgical intervention.

The report also noted a moderate impairment in the movement and flexion of the right hip joint during walking, leading to a permanent disability rate of 20%. The victim’s legal representative stressed that the party responsible for the accident was convicted in a criminal judgment, which was subsequently upheld.

He referred to Articles 309 of the Criminal Procedure Law, Article 100 of the Law of Evidence, and Article 158 of the Civil Law, stating, “The final criminal judgment rendered by the criminal court in the criminal case, whether acquittal or conviction, is binding on the civil courts in lawsuits where no final judgment has been issued regarding the occurrence of the crime, its legal description, and attribution to the perpetrator.” He further emphasised that “any mistake causing harm to others obligates the one responsible to compensate for it.
