Husband jailed for refusing to hand over two daughters

The High Sharia Court has sentenced an Asian man to one year in prison for refusing to hand over his two daughters to his wife, despite a court order granting her custody.

The man claimed the children were staying with his mother in their home country with his wife’s consent, but the court found his argument baseless.

The couple, who married and had their children in Bahrain, traveled to the husband’s home country for a vacation.

The wife returned to Bahrain first due to work commitments, expecting her husband and daughters to follow. However, upon their arrival date, the husband returned alone, leaving the children with his f amily. The wife, distraught and unable to contact her daughters, filed for custody in the Sharia Court.

The court ruled in her favor, granting her custody and ordering the husband to hand over the children.

The ruling was upheld by the Court of Appeals. Despite the court orders, the husband continued to deny his wife access to their daughters. The wife, represented, pursued legal action against her husband for his non-compliance.

False The claimant’s lawyer argued that the husband’s claims of an agreement to leave the children with his mother were false, as evidenced by the repeated court rulings granting custody to the wife.

The lawyer emphasised that the husband’s actions were causing unnecessary hardship for the mother and depriving her of her right to be with her daughters.

The court, convinced by the evidence and arguments presented, found the husband guilty of violating the custody order and sentenced him to one year in prison.

The court also imposed a fine and set bail at BD500 for the suspension of the sentence.
