Bahraini project manager takes restaurant owners to court over back pay, wins

A 30-year-old Bahraini project manager has successfully recovered her rights through a final ruling issued by the Cassation Court. The court ordered two Gulf nationals, with whom she had agreed to manage a group of restaurants through documented contracts, to pay her BD7,009.

According to lawyer Ghadeer Al A’ali, the project manager had filed a lawsuit against the company and its partners, seeking payment of BD9,009 for her services. She claimed that she had fulfilled her obligations under the agreement and provided additional services, but the company had failed to pay her in full.

The initial court ruled in favour of the project manager, ordering the company to pay her BD7,009. However, the company appealed the decision, claiming that one of the contracts was invalid due to a disputed signature.

The Court of Appeals appointed an expert to examine the signature, who concluded that the contract was indeed invalid. As a result, the Court of Appeals overturned the initial ruling and dismissed the case. Undeterred, the project manager appealed the decision to the Court of Cassation.

Evidence

The higher court reviewed the evidence and found that the expert’s report was flawed. The court noted that the project manager had provided two other valid contracts, which were sufficient to prove the agreement and her entitlement to payment.

Based on this finding, the Court of Cassation overturned the decision of the Court of Appeals and reinstated the initial ruling. The court ordered the company to pay the project manager BD 7,009, recognising the validity of the agreements and her right to compensation for her services.
